Welcome to The Forge

These Terms of Service ("Terms") govern your use of The Forge, an AI-powered content platform operated by Nomads Passage Inc. doing business as (DBA) Masterforge Media. By subscribing to The Forge, you agree to these Terms.

Plain English Summary: This is the legal agreement between you and us. We'll keep it simple.

1. Your Account

Who Can Use The Forge

• You must be at least 18 years old
• You must provide accurate billing information
• You're responsible for keeping your password secure

One Account Per User

• Don't share your login credentials with others
• If you need multiple users, contact us about an Enterprise plan (coming soon)

2. Pricing & Billing

Standard Pricing

• Monthly: $197 USD / $247 CAD
• Annual: $2,149 USD / $2,699 CAD

Founding Member Discount (Limited Time)

If you subscribe before December 31, 2025, you may use the discount code FOUNDING50 to receive 50% off the standard rate.

• This discount applies for the lifetime of your subscription.
• Condition: You must maintain an active subscription.
• Expiry: This offer expires on December 31, 2025 or when 50 spots are filled, whichever comes first.

IMPORTANT: If you cancel your subscription or allow it to lapse, the discount code will no longer be valid for re-subscription. You will have to pay the full standard rate upon returning.

Payment Terms

• Monthly plans are billed on the same day each month
• Annual plans are billed once per year
• All payments are processed through Stripe
• Prices may increase for new subscribers (but your rate is locked in)

3. Refund Policy

30-Day Money-Back Guarantee (Annual Plans Only)

The 30-day money-back guarantee applies ONLY to Annual plans.

Monthly Plans:

• Monthly subscriptions are non-refundable.
• You can cancel anytime to stop future billing, but we do not offer refunds for partial months or the current billing cycle.

Annual Plans:

• If you are not happy, get a full refund within 30 days of your first payment.
• Email support@masterforgemedia.com to request a refund.

After 30 days:

• Annual plans are non-refundable after 30 days (but you can cancel anytime).

4. Service Availability

Uptime Commitment

We aim for 99.9% uptime, but we don't guarantee uninterrupted service.

Things that might cause downtime:

• Scheduled maintenance (we'll notify you in advance)
• Server issues (we'll fix them ASAP)
• Third-party API failures (Instagram, OpenAI, etc.)

What happens if we're down:

• We'll work to restore service as quickly as possible
• We don't offer refunds for temporary outages
• If downtime exceeds 24 hours, contact us for a credit

5. Content Ownership

You Own Your Content

All content generated by The Forge belongs to you. This includes:

• Content ideas
• AI-generated images
• Captions and copy
• Brand DNA results

We don't claim any rights to your output.

What We Can Use

We may use anonymized, aggregated data to improve the platform (e.g., "Users who approve trend-based ideas see 20% higher engagement"). We will never share your specific content publicly without permission.

6. Acceptable Use

You Agree NOT To:

• ❌ Violate our Fair Use Policy
• ❌ Use The Forge for illegal purposes
• ❌ Generate content that violates third-party copyrights
• ❌ Resell or redistribute generated content in bulk
• ❌ Attempt to reverse-engineer or hack the platform
• ❌ Use automated scripts to abuse the system

Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms or the Fair Use Policy.

We'll always warn you first (unless the violation is severe, like hacking).

7. Roadmap & Feature Disclaimers

Features Are Estimates, Not Promises

We maintain a public roadmap showing planned features (e.g., auto-posting, analytics, team collaboration).

Important:

• Roadmap features are subject to change
• We do not guarantee delivery timelines
• Features may be delayed, modified, or canceled

Why this matters:

• We're a small team building fast
• Priorities shift based on user feedback
• We can't promise exact dates

What you CAN expect:

• We'll communicate major changes
• We'll prioritize features that users actually want
• We'll be transparent about delays

8. Cancellation

You Can Cancel Anytime

Monthly plans:

• Cancel anytime from your Settings page
• You keep access until the end of your billing period
• No refunds for partial months

Annual plans:

• Cancel anytime, but no refunds after 30 days
• You keep access until the end of your annual term

Founding Members:

• Remember: If you cancel, you lose your 50% discount forever

9. Changes to These Terms

We may update these Terms from time to time. If we make significant changes, we'll notify you via email at least 30 days in advance.

By continuing to use The Forge after changes take effect, you agree to the new Terms.

10. Limitation of Liability

We're not liable for:

• Lost revenue or business opportunities
• Errors in AI-generated content
• Third-party platform changes (e.g., Instagram API changes)
• Data loss (though we back up regularly)

Maximum liability:

• Our total liability is limited to the amount you paid in the last 12 months

This is standard legal protection. We'll always do our best to make things right if something goes wrong.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.

Dispute Resolution:

Any disputes arising from these Terms or your use of The Forge shall be resolved exclusively in the courts located in Toronto, Ontario.
